OCEAN MANAGEMENT SYSTEMS, INC. (OMS®) CONSUMER WARRANTY LIMITED WARRANTY ONE-YEAR WARRANTY OMS® products are warranted to be free from defects in material and workmanship) 1 year from the date of original purchase except where otherwise noted. Proof of purchase (Original receipt) is required with the serial number of the item recorded on the receipt where applicable. The exclusive remedy for this warranty is that Ocean Management Systems, Inc. will, at its option, provide repair or replacement components for this product. Ocean Management Systems, Inc. reserves the right to discontinue or change materials, parts, models or products, or to make substitutions. WARRANTY LIMITATIONS This warranty does not apply to normal wear and tear, commercial or rental use, after-market modification, or damages which arise from negligence, misuse, use not in accordance with the product instructions and if in the event there is a dispute, OMS® in its sole discretion will make the final decision with regard to whether or not the product is covered by the OMS® warranty. This warranty will not cover products that have been held by the dive store in excess of 2 years (24 months) from date of purchase from OMS® or that are shop worn, damaged , not in new condition or used (this must be reported to OMS® on the day of purchase). Repairs made under this warranty will not extend the warranty period (exception:OMS® Factory BC Refurbishment program). All further claims, especially for damage after diving accidents, are excluded from coverage under this warranty. Ocean Management Systems, DBA OMS® has no obligation to honor any extension of this warranty. LIMITATION OF DAMAGES The warranty and remedies as set forth above are exclusive and in lieu of all others, oral or written, express or implied. In no event will OMS®, or the retailer selling this product, be liable for any damages, including incidental or consequential damages, arising out of the use or inability to use this product. LIMITATIONS OF WARRANTIES AND OTHER WARRANTY TERMS AND STATE LAWS Any implied warranties, including warranties of merchantability and fitness for a particular purpose, shall be limited to the duration and terms of the express written warranty. Some states do not allow limitations on how long an implied warranty lasts or the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply. This warranty gives you specific legal rights, and you may have other rights, which vary from state to state. Neither OMS®, nor the retailer selling this product, authorizes any person to create for it any other warranty, obligation, or liability in connection with this product. This new warranty information takes effect December 10, 2009. AUTHORIZED RETAILERS/INTERNATIONAL DISTRIBUTORS Please visit the nearest, authorized Ocean Management Systems, Inc. retailer or authorized online retailer or International Distributor to purchase your Ocean Management Systems, Inc. equipment. A list of Ocean Management Systems, Inc. authorized retailers and International Distributors can be found on our website : OMS® Dealers. Not all products are available at all retailers and International Distributors. WARRANTY REPAIR POLICY In order to receive warranty consideration a product with all components installed must be returned to the authorized Ocean Management Systems, Inc. dealer or International Distributor from which the product was purchased OR directly to Ocean Management Systems, Inc. Headquarters. NOTE: OCEAN MANAGEMENT SYSTEMS, INC.AND ITS AUTHORIZED DEALERS AND INTERNATIONAL DISTRIBUTORS ARE NOT OBLIGATED TO PAY FOR SHIPPING OR INSURANCE ON WARRANTY CLAIMS. Ocean Management Systems, Inc. will only accept returned equipment that has been issued a Return Merchandise Authorization Number (RMA) from Ocean Management Systems, Inc. To request a Return Merchandise Authorization Number (RMA), call Ocean Management Systems, Inc. at 1-845 692 3600 and provide the following information:

Ocean Management Systems, Inc. will only receive product that has a valid Return Merchandise Authorization Number (RMA) plainly visible on the outside of the box. Without a Return Merchandise Authorization Number on the outside of the box the product will be refused. ALL returns are subject to inspection and final approval by Ocean Management Systems, Inc. certifying that the problem is covered by our warranty. Ocean Management Systems, Inc. is not responsible for damage due to shipping or insurance claims. Be sure to package your return merchandise carefully. Ocean Management Systems, Inc. will only replace a product when necessary and with a comparable replacement. Credits are not issued for returned product. WARRANTY EXCLUSIONS:
Non-Warranty Repair Policy Any service and/or repair requested for a product for which the factory warranty period has expired or has been invalidated because of customer-induced damage (resulting from misuse, abuse, missing components, or modification) is considered a non-warranty service. Refurbishment (excluding the new OMS® BC factory refurbishment program) or upgrading of product to the latest specification is considered a non-warranty repair or service. If an estimate is required by the customer for non-warranty repairs or services, there is a repair estimate fee of $30.00. Customer must agree to pay this amount by credit card before shipping the defective product to Ocean Management Systems Inc. (or at the time that OMS® notifies the customer that the product is not covered by warranty). OMS® will examine the returned items and send the customer a quote for the repairs, the amount of which will be based off the then-prevailing time and material rates as determined by OMS®. OMS® will not work on the repairs until it receives written authorization form from the customer. If the customer chooses not to repair the item, he will be responsible for the cost of the repair estimation and for all shipping and insurance charges. OMS®, at its sole discretion, may decide not to repair a non-warranty part. If the customer chooses to repair the item, the $30.00 repair estimate fee will be credited against the total invoice. The customer will remain responsible for all shipping (to and from OMS) charges as well as insurance. Out of Warranty form |
